Decrees of Social Emergency are unconstitutional, says presentation of the justice Iván Palacio
This way it was determined by the justice of the Constitutional Court on having presented today, on Wednesday, his/her presentation before his/her colleagues in (Sala Plena).
The Government had decreed the reform to the health to conspire the crisis that one presents in the system of health, some of the measures of the sent decrees were including the creation of new taxes.
According to the presentation, the crisis of the health is structural and there are no elements that sustain a concrete fact that he/she deserves to declare the Social Emergency.
In a concept dedicated to the Court the attorney, Alejandro Ordóñez, had requested imposible declared the Social Emergency on having thought that there were not meeting the requirements for that the constitution asks to send these decrees.
According to the attorney the faults come from time behind and can be solved by laws of the Congress.
At 3:00 p.m. the study of the presentation was beginning in Sala Plena of Ivan Palacio.
